DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA) COMPLIANCE POLICY

Legend Enterprises, Inc. ("Company") operates as an independent infrastructure and managed server hosting provider. In accordance with Title 17, United States Code, Section 512(c)(2) (the "Digital Millennium Copyright Act" or "DMCA"), the Company has designated an agent to receive formal notifications of alleged copyright infringement occurring within our server networks, client cPanel containers, or digital platforms.

We respect the intellectual property rights of third parties. It is our strict policy to investigate legitimate claims of copyright infringement and, where appropriate, implement the 'safe harbor' provisions of the DMCA, which may include the temporary suspension or termination of accounts that repeatedly violate these parameters.

1. Requirements for Filing a Valid Infringement Notice

To be legally effective under the DMCA, all notifications of alleged copyright infringement must be submitted in writing to our Designated Agent and must contain the following six (6) structural elements:

1. Identification of the Protected Work: A clear, detailed description of the copyrighted work claimed to have been infringed. If multiple works are involved on a single site, please provide a comprehensive list.


2. Identification of the Infringing Material: A specific description of the material that is claimed to be infringing, including the exact URL or cPanel file directory path necessary to permit our infrastructure team to locate and isolate the asset.


3. Claimant Contact Information: Direct coordinates for the complaining party, including a physical mailing address, a functional telephone number, and an active business email address.


4. Good Faith Statement: A formal statement that the complainant has a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its legal agent, or applicable law.


5. Statement of Accuracy & Perjury: A statement that the information provided in the notification is accurate, and under penalty of perjury, that the complaining party is fully authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
6. Authorized Signature: A physical or electronic signature of the copyright asset owner or a person legally authorized to act on their behalf.

Pre-Notification Notice: Please note that under Section 512(f) of the DMCA, any person who knowingly and materially misrepresents that material or activity is infringing may be held civilly liable for damages, including court costs and attorney fees incurred by the alleged infringer or by Legend Enterprises, Inc.
